GREEN MAN GAMING APRIL PRIZE DRAW TERMS AND CONDITIONS

By entering the Green Man Gaming April Prize Draw (“Contest”), entrants agree to be bound by these Terms and Conditions.

Green Man Gaming Ltd. (the “Sponsor”) reserves the right to cancel or amend the Contest or the Terms and Conditions without notice in the event of a catastrophe, war, civil or military disturbance, act of God or any actual or anticipated breach of any applicable law or regulation or any other event outside Green Man Gaming’s reasonable control. Any changes will be posted within these Terms and Conditions. A copy of the Terms and Conditions may also be obtained by contacting [e-mail] by email.

Contest entries will be drawn from all eligible registered customers having earned an entry into the Contest between 16:00 GMT 13 April 2021 to 23:59 GMT 20th April 2021 (“Contest Period, time may vary”).

You acknowledge and agree that you will provide at your own cost and expense the equipment, Internet or other connection charges, required to enter the Contest. Green Man Gaming makes no warranty that the Store can be accessed on all personal computers, games consoles, smartphones, tablets or other devices (each, a “Device”, or in the plural, “Devices”), by means of any specific Internet or other connection providers, or in all countries. You are solely responsible for any third party costs you incur to enter the Contest.

Green Man Gaming makes no warranty or guarantee that the store will be available to use for the duration of the Contest Period.

In the event of any dispute regarding the Terms and Conditions, results, entry, and all other matters relating to the Contest, the decision of the judge(s) shall be final and no correspondence or discussion shall be entered into.

ELIGIBILITY

All players wishing to be entered into the Contest must complete their eligibility requirements before the end of the Contest Period. Employees of Green Man Gaming, its affiliate, advertising, promotion, fulfilment, service partners and their immediate families are ineligible to enter.

Green Man Gaming assumes that by entering the Contest (you warrant that) you are aged 18 or over or, if you are under 18, that your parents have consented to your entry into the Contest and these Terms and Conditions.

By entering the Contest, you hereby grant Green Man Gaming the right to use your likeness, name and Green Man Gaming Profile identity for promotional purposes.

Green Man Gaming reserves the right to disqualify any entrant if it has reasonable grounds to believe the entrant has breached any of the Terms and Conditions.

AUTOMATIC ONLINE ENTRY

In order to be eligible for the Contest, Entrants must complete actions via the Gleam competition mechanics which can be found on the Green Man Gaming website. By completing the actions, Entrants gain entries for the Giveaway. Some actions are worth more entries than others. Users may have multiple entries. There is no purchase requirement to enter the Contest.

Green Man Gaming is not responsible for any service outages, Store error, maintenance periods or other technical issues that result in an entrant's eligibility being completed.

PRIZES

The winners of the Contest (“Winners”) will be determined by drawing six (6) entries at random from all eligible entries received.  There will be one (1) winner in the Gold Prize tier, two (2) winners in the Silver Prize tier and three (3) winners in the Bronze Prize tier.

The odds of winning the Contest depend on the total number of eligible entrants. Green Man Gaming is not obliged to reveal the total number of entries in the prize draw.

Green Man Gaming will not replace any lost or stolen prizes. Winners are solely responsible for any and all federal, state, provincial and local taxes if any, that apply to prizes. If a prize is mailed, the winner assumes the risk of the prize’s safe arrival. Prizes are offered “as is” with no written, express, or implied warranty. The prizes will be sent once. If returned, a new winner will be chosen.

Winners will be notified by email within twenty-two (22) business days of the prize drawing and may be required to sign and return an affidavit of eligibility and publicity/liability release within fourteen (14) days of notification. If a selected winner cannot be contacted, is ineligible, fails to claim a prize and/or where applicable an affidavit of eligibility and publicity/liability release is not timely received, is incomplete or modified, the prize may be forfeited and an alternate winner selected from remaining valid, eligible entries submitted. 

The exact timing of the fulfilment of the prizes will be subject to stock availability, in the case of physical products, or any release date embargos, for digital products. Winners will have the choice between a full-release version or an upgrade version of the The Elder Scrolls Online Collection: Blackwood.

Prizes are non–transferable and there is no cash alternative. Green Man Gaming reserves the right to substitute prizes of equal or greater value at any time.

DATA PROTECTION AND PUBLICITY

The Winners may be requested to take part in promotional activity and Green Man Gaming reserves the right to use the names and Steam identities in any publicity both in paper and online.

The Gold Prize tier Winner consents to their data, including full name and address, being provided to noblechairs for the purposes of fulfillment of the prize on behalf of Green Man Gaming.

Any personal data relating to entrants will not be disclosed to a third party without the individual’s consent. Please see the Green Man Gaming Privacy Policy for further details. Data relating to entrants will be retained by Green Man Gaming for a reasonable period after the Contest closes to assist Green Man Gaming to operate future competitions in a consistent manner and to deal with any queries on the Contest.

By providing Green Man Gaming with your personal data you consent to Green Man Gaming transferring your personal data to countries or jurisdictions which do not provide the same level of data protection as the UK. If Green Man Gaming does make such a transfer it will, if appropriate, put a contract in place to ensure that your personal data is protected.

GENERAL

ANY ATTEMPT BY AN ENTRANT OR ANY THIRD PARTY TO CIRCUMVENT, TAMPER, DISRUPT OR DAMAGE THE CONTEST ENTRY PROCESS, GREEN MAN GAMING WEBSITE OR TELEPHONE SYSTEMS, DEFRAUD OR GAIN AN UNFAIR ADVANTAGE, ENGAGE IN UNSPORTSMANLIKE, DISRUPTIVE, ANNOYING, HARASSING OR THREATENING CONDUCT, OR OTHERWISE UNDERMINE THE FAIRNESS, INTEGRITY AND LEGITIMATE OPERATION OF THE CONTEST, WILL RESULT IN AUTOMATIC DISQUALIFICATION FROM THE CONTEST AND MAY CONSTITUTE A VIOLATION OF CRIMINAL AND CIVIL LAWS. GREEN MAN GAMING RESERVES ALL RIGHTS, INCLUDING THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEYS’ FEES), TO THE FULLEST EXTENT OF THE LAW, INCLUDING THE POSSIBILITY OF CRIMINAL PROSECUTION.

Entrant agrees to release, discharge, indemnify, defend and hold harmless Green Man Gaming,  affiliates, subsidiaries, its business partners, prize providers, and promotion and advertising agencies, and directors, officers, employees and agents of any and all of the aforesaid, and any other organizations related to the Contest, from and against any claim, damages or liability due to any injuries, losses or damages to any person (including death) or property of any kind resulting in whole or in part, directly or indirectly, from receipt, enjoyment, ownership, possession, use, misuse or inability to use any prize, or participation in the Contest or a related activity, whether under contract, tort (including negligence), warranty or any other applicable sources of law, including, without limitation (i) any condition caused by events beyond Green Man Gaming’s control that may cause the Contest to be disrupted or corrupted; (ii) any injuries, losses, or damages (compensatory, direct, incidental, consequential or otherwise) of any kind arising in connection with or as a result of the prize, or acceptance, possession, or use of the prize, or from participation in the Contest; and (iii) any printing or typographical errors in any materials associated with the Contest.

IN NO EVENT WILL GREEN MAN GAMING BE LIABLE TO YOU FOR ANY DIRECT, SPECIAL, INCIDENTAL, EXEMPLARY, PUNITIVE OR CONSEQUENTIAL DAMAGES (INCLUDING LOSS OF USE, DATA, BUSINESS OR PROFITS) ARISING OUT OF OR IN CONNECTION WITH YOUR PARTICIPATION IN THE CONTEST, WHETHER SUCH LIABILITY ARISES FROM ANY CLAIM BASED UPON CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, AND WHETHER OR NOT GREEN MAN GAMING HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH LOSS OR DAMAGE. Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so the above limitation or exclusion may not apply to you.

Green Man Gaming assumes no responsibility for any administrative or typographical errors in the course of operating the Contest or in the Contest Terms and Conditions. Green Man Gaming reserves the right, in its sole discretion, to cancel, modify or suspend the Contest in whole or in part, in the event of fraud, technical or other difficulties or if the integrity of the Contest is compromised, without liability to the entrant. Green Man Gaming reserves the right to disqualify any entrant or Winner, as determined by Green Man Gaming, in its sole discretion. The Contest is subject to these Contest Terms and Conditions and the Contest Official Rules and all applicable federal, state, provincial and local laws and regulations apply. As stated above, the Contest is void where prohibited or restricted by law. By participating in these Contest, you acknowledge that you have read these Contest Terms and Conditions and the Contest Official Rules and agree to abide by them and by the decisions of Green Man Gaming, which are final and binding on all matters pertaining to the Contest. The Contest and Terms and Conditions will be governed by English law and any disputes will be subject to the exclusive jurisdiction of the courts of England. Where the Store is accessed from Scotland or Northern Ireland, this Agreement shall be governed by the laws of Scotland or Northern Ireland respectively and you hereby submit to the exclusive jurisdiction of the Scottish courts or the courts of Northern Ireland respectively.
